ABOUT NICOLE FALCEY

I’m an employment attorney who helps employers across the country navigate wage and hour class and collective actions, pay equity disputes, and complex employment litigation. I defend companies against claims under the Fair Labor Standards Act (FLSA), state wage and hour laws, and new pay transparency and equal pay statutes, and I also work closely with businesses to avoid potential claims through strategic compliance counseling. Clients turn to me for sharp judgment, practical advice, and an ability to see the big picture. I know that legal compliance doesn’t happen in a vacuum — it has to fit the real-world demands of running a business. My focus is on delivering strategies that not only protect companies legally, but also support their broader business objectives. In my litigation practice, I’ve helped protect companies against large-scale exposure and resolve complex multi-plaintiff actions across a range of industries. I also advise clients on pay audits, wage and hour risk assessments, and compliance programs, helping them stay ahead of the increasingly aggressive enforcement landscape. Clients describe me as perceptive, strategic, and relentlessly focused on practical solutions. Whether defending a lawsuit or building a compliance program, I bring a measured and tactical approach to help position businesses for sustained success. In addition to my client work, I was honored to be selected as a 2024 Fellow of the Leadership Council on Legal Diversity (LCLD), and I’m active in attorney recruiting and mentoring within my firm.
