Employed (contractor) as a subject matter expert within the Office of Capital Access at the SBA. Initially tasked with assessing the collectability of defaulted 504 loans that had been repurchased from lenders. The analysis involved review of appraisals and/or estimating the value of collateral, review of legal standing and the status of senior liens, and the assessment of the financial wherewithal of borrowers and guarantors. Subsequent duties involved serving as a senior member of a team tasked with reviewing and correcting, when applicable, previous loan forgiveness adjudications. The current assignment involves providing rule based and conceptual clarity on loan forgiveness decisions that have been appealed through the Office of Hearings and Appeals. These decisions will either be reversed or supported through a report that could be used by SBA attorneys in their briefs and pleadings before the administrative law appeals judge. This assignment requires the expert level understanding and implementation of the rules contained in the CARES Act, The American Rescue Plan, as well as the Interim Final Rules and the Standard Operating Procedures promulgated by the SBA. The required due diligence involves tax return analysis, open source background investigations of the nature and characteristics of the borrower’s business and the principals identity and character, as well as of the application of banking industry practices and knowledge.
