Environmental: • Represent in US Courts of Appeals manufacturer of substances targeted in first four EPA risk management rules (after asbestos) under TSCA as amended. • Represented major fluorochemicals manufacturer in successful challenges to EPA SNAP delisting rules in US Court of Appeals for the DC Circuit. • Brought challenge to ban on consumer use of methylene chloride in US Court of Appeal for the Ninth Circuit. • Supported fluorochemicals industry in enacting legislation to phase down HFCs in accordance with the schedule in the Kigali Amendment to the Montreal Protocol on Substances That Deplete the Ozone Layer. • Represent importer of chlorinated paraffins in EPA regulatory/enforcement matters. • Formed and represent consortia to conduct testing in lieu of EPA test rules or for pesticide registration. • Participated in rulemakings and litigation challenging EPA NESHAPs for dry cleaning, solvent cleaning, wood furniture manufacturing, and other sources. • Challenged OSHA methylene chloride standard in the US Court of Appeals for the DC Circuit, and negotiated satisfactory settlement with union support. • Organized coalition of formulators and users and initiated lobbying activities successfully challenging OSHA asbestos standard for removal of ban on aerosol brake cleaners. • Represented petitioner in successful litigation to overturn OSHA permissible exposure limit (PEL) update.
