Reported successesHart v. State, 260 Md. App. 491, 310 A.3d 11••••24)- Appellate Court of Maryland held, as a matter of first impression, that the “per se approach” to determining whether a party\'s explanations for exercising peremptory strikes are neutral applies in Maryland and the prosecutor\'s reasons for exercising peremptory strikes against two male prospective jurors, one of which was desire for more gender-diverse jury, involved consideration of impermissible factor of gender, and thus, was not “neutral” per se, under Batson v. Kentucky, 476 U.S. 79 (1986).State v. Meadows, No. 1750, 2024 WL (Md. Ct. Spec. App. Apr. 22, 2024)- Appellate Court of Maryland held that a prisoner does not waive their right to the speedy trial protections of the Interstate Agreement on Detainers (IAD) by not objecting to a trial date that falls after the 180-day deadline and, as a matter of first impression, the State does not satisfy the IAD\'s 180-day deadline by dismissing district court charges before the deadline and then indicting a prisoner in circuit court.Howard v. State, No. 0338, 2024 WL 17•••08 (Md. Ct. Spec. App. Apr. 24, 2024)- Appellate Court of Maryland held the State bears the burden to negate the “Colt AR-15 Sporter H-BAR rifle” exception in the statutory definition of a regulated firearm and the evidence was insufficient to establish that the missing firearm in question was not a “Colt AR-15 Sporter H-BAR rifle,” which was exempt from the statutory definition of a regulated firearm.
