I work with a range of landlords, tenants, developers and lenders, and have particular experience in the following- Portfolio management for both tenants and landlords in a variety of sectors, including retail and logistics- Managing lease renewal claims- Advising on disputes concerning break notices, having previously been successful in applying for a declaration in the High Court that a break notice served by a retail client validly terminated its lease- Providing advice to landlords and tenants in respect of claims for rent arrears and other lease payments, including experience in providing strategic advice in respect of difficulties faced by landlord and tenant clients as a result of COVID-19 including experience in the new arbitration process introduced by the Commercial Rent (Coronavirus) Act 2022, having worked on the first recorded case under this scheme- Delivering strategic advice on landlord insolvency in respect of investment properties- Providing strategic advice to landlords seeking vacant possession of a property with a number of occupiers- Advising on and managing repossession claims in respect of properties owned by commercial borrowers on behalf of lenders/LPA receivers, including the recovery of a hotel premises and residential property- Providing advice to tenants in relation to dilapidations claims and repair obligations- Advising on water ingress issues at leasehold properties on behalf of tenants- Providing advice on issues arising on development sites, including interference with rights of way and other easements; and- Providing forfeiture advice to landlords.

ABOUT STEPHANIE HADLEY
I am an Associate in the Real Estate Litigation team based in the Birmingham office. I qualified in September 2019 after completing my training contract with Squire Patton Boggs. I am experienced in a wide range of real estate litigation matters for clients ranging from sectors including retail, logistics and finance.I am experienced in a number of areas of real estate litigation, including lease renewals, break options, dilapidations, forfeiture, rent arrears, possession proceedings and property insolvency and have worked with a number of clients including tenants, landlords, charities, financial institutions and developers.I worked on the first recorded case brought under the arbitration scheme introduced under the Commercial Rent (Coronavirus) Act 2022 and regularly manage a number of disputes related to rent arrears. This includes responding to statutory demands (including applying for injunctive relief), defending against money claims issued at court and issuing pre-action letters to recover rent arrears. My recent work highlights include obtaining a declaration from the High Court confirming that a tenant had validly terminated their lease following service of a break notice, being successful on all points in dispute. I have also been successful in obtaining an order for possession of a residential property for a financial institution while the property remained in positive equity, together with obtaining an order allowing the client to apply for an order for wasted costs from the defendant’s lawyers.
