Environmental Experience • Counsel manufacturing and industrial clients in all aspects of environmental law including the Clean Water Act (CWA), Clean Air Act (CAA), Resource Conservation and Recovery Act (RCRA) and Emergency Planning and Community Right to Know Act (EPCRA) regulations implemented by the EPA and the states, as well as hazardous materials regulations for shippers and transporters implemented by the DOT, FRA and FAA. • Defend and negotiate reduced penalties for enforcement actions under these federal environmental statutes and related state statutes. • Partner with clients and their EHS teams to overhaul and update Environmental Management Systems and craft corrective action plans in response to agency enforcement actions. • Pilot clients through the environmental due diligence of real estate and manufacturing operations in large, multi-national acquisitions for significant transactions including $800+ million deals. • Litigate permit and cost recovery disputes. • Litigate mold and toxic tort cases involving property damage and personal injuries.
