Representative matters:* Successfully negotiated reversal of the Government\'s termination for cause of an Industrial Base Expansion contract & favorable settlement of the contractor\'s eight-digit contract claim.* Successfully defended award of a $126 million Blanket Purchase Agreement to a woman-owned small business against protests to the Government Accountability Office & Small Business Administration.* Successfully defended a subcontractor under a government contract against a multimillion-dollar demand for back wages.* Successfully defended award of a $90 million task order for building maintenance services against a protest to the U.S. Court of Federal Claims.* Represented restaurant chain in successful Zoom mediation & favorable settlement of a multi-million-dollar class action claim by tipped workers for back wages and statutory penalties.* Successfully protested the contracting officer’s choice of NAICS code in a solicitation for helicopter engine overhaul and repair services.* Won dismissal of Lanham Act suit brought by incumbent contractor against bidder for defense contract.* Won summary judgment for a contractor sued in federal court for alleged copyright infringement, persuading the court that the Government, not the contractor, was the proper defendant.* Developed litigation strategy and conducted discovery & motion practice in both Court of Federal Claims & Civilian Board of Contract Appeals leading to multi-million dollar settlement of about 30 changes claims under a Government contract.* Led the Federal Circuit to reverse the ASBCA & grant summary judgment to the contractor on its SCA price adjustment claim.* Successfully opposed bid protest against contract award to client, even though awarding agency agreed with protestor that evaluation was flawed.* Persuaded the Federal Circuit to void contractor\'s release of its claims.* Defended a major subway system against a $47 million claim by a construction contractor.* Successfully represented contractor in persuading the ASBCA to vacate its denial of client’s $21 million claim & to schedule the claim for a new hearing, ultimately leading to multi-million judgment for the client.* Conducted numerous wage-hour audits to help clients stay or become compliant with the FLSA & SCA.

I am a member of the Government Contracts Group and focus on the areas of government procurement and commercial law and litigation, wage and hour law and construction law, including preparing, negotiating and litigating contract claims and bid protests, as well as advising clients on contract compliance, small business, subcontracting and data rights issues under government contracts. I also represent clients in connection with minimum wage, working time and overtime issues under the Federal Fair Labor Standards Act (FLSA), Service Contract Act (SCA), Davis-Bacon Act and state wage payment and prevailing wage laws. This includes conducting proactive wage-hour audits for employers as well as litigation of minimum wage, overtime and wage payment claims.
