About Roy Goldberg

I am an aviation trial, appellate and regulatory litigator focused on cases involving airlines, airports, the Airline Deregulation Act; antitrust law, class actions, general aviation, fixed-based operators, airline catering businesses, aircraft charter companies, and the business aircraft industry, with particular emphasis on using federal preemption and other strategies to defend against class actions, including RICO and antitrust allegations, Air Carrier Access Act claims, the enforcement of federal grant assurances applicable to airports, and transportation industry sustainability issues. I also handle matters before the U.S. Circuit Courts of Appeal, Commerce Clause litigation, draft air carrier contracts of carriage and I work on a wide range of DOT, FAA, and TSA regulatory issues, as well as the pursuit of challenges to airport rates and charges, and state and local taxes and fees as violating the federal Anti-Head Tax Act. I also represent litigants in international trade disputes. On behalf of airlines and other aviation entities, I have successfully challenged hundreds of millions of dollars in government-imposed user fees, taxes and charges in the D.C. Circuit and obtained dismissal of more than a dozen federal and state lawsuits as preempted by the Airline Deregulation Act, including cases relating to ticket fares and taxes, aircraft operations, and air carrier services. I help aeronautical service providers enforce airport grant assurance obligations. I also work on privacy law issues for the airline industry and handle tax disputes for carriers and contract and product liability cases involving aircraft and helicopters. In addition, I have a general commercial litigation practice, including patent litigation, eminent domain, breach of contract and products liability cases across a range of industries. I also have represented domestic and foreign producers in antidumping and countervailing duty cases before the U.S. Department of Commerce and International Trade Commission involving a range of commercial industries. I also defend parties in disputes over maritime shipments and regulations. I have argued more than 25 appeals before U.S. Circuit Courts of Appeal and has obtained preliminary injunctions on behalf of patent holders. In addition, I have represented companies before arbitration panels throughout the United States and Europe.
