About Robert Shwarts
I am a partner in Orrick\'s San Francisco office, and am an experienced trial attorney, having successfully litigated more than 40 trials and arbitrations in trade secret, commercial litigation and employment matters. My experience includes litigation and counseling relating to trade secret misappropriation and non-compete/non-solicitation agreements, including numerous TRO and preliminary injunction proceedings. I also have broad experience in commercial litigation, having successfully litigated claims of securities fraud, lender liability, breach of contract, breach of fiduciary duty, breach of warranties, claims arising from securitization transactions and other business fraud. My employment-related litigation includes defending claims of wrongful discharge, retaliation, sexual harassment, wage-and-hour violations (including class actions) and breach of contract, as well as claims of discrimination based on race, religion, age, disability, medical leave, gender and sexual preference under federal and state law.Additionally, I regularly represent U.S. and international clients with significant California presence, including numerous financial services companies. My experience includes jury and non-jury trials, ITC litigation, as well as and FINRA (formerly NASD and NYSE) arbitration hearings.I am proud to have served on the board of Point Blue Conservation Science, and also enjoy supporting Patrons of Diplomacy, SFMoMA and other San Francisco arts organizations.
