ABOUT ROBERT A. KOENIG

I bring real world experience to my work assisting business clients in the areas of ERISA and employee benefits litigation, construction litigation, surety bond litigation, and technology, including ADA website accessibility compliance. Practicing for 25 years and handling a broad range of issues, I have a deep understanding and a wealth of responses to issues that are raised throughout all phases of litigation. As lead litigation counsel, I collaborate with my clients to understand all facets of their businesses and address their individual inner workings and needs. I have extensive practice experience before U.S. District and Bankruptcy courts and regularly serve as counsel in litigation matters for numerous local, Ohio and national plans, boards of trustees, sponsors, employers, and third-party administrators in all phases of ERISA and employee benefits litigation. In addition, I defend breach of fiduciary duty claims, class action suits asserting ERISA claims, and denial of benefits brought by individual participants. On the construction side of my practice, I have significant experience in all phases of commercial, construction, and surety bond litigation. I regularly represent owners, contractors, subcontractors, materials providers, and surety companies in various litigation matters, as well as in the preparation and presentation of construction claims in arbitrations under the Construction Industry Arbitration Rules. Technology clients draw on my proactive approach to counsel in matters such as technology development agreements that protect the purchasing party’s goals and clearly articulate the critical deliverables, testing, deployment, acceptance, and support phases of the project. I routinely represent software developers, digital agencies, website designers and media promoters with protecting their new technologies, ideas, and inventions through aggressive licensing provisions in all of their agreements.
