ABOUT RICHARD A. SIMPSON

I am a trial lawyer and appellate advocate. As an AUSA in SDNY, I learned to love nothing so much as going to trial, unless it is crafting briefs and presenting oral argument in an important appeal. Assistants in that office were fortunate to be able to do both.My litigation philosophy is simple: Be alert from day one for opportunities to settle if it in the client\'s best interest but always expect to go to trial if necessary. In my experience, the best settlements are achieved when the other side knows the opposing counsel is not a \"litigator\" who secretly fears trial but instead a trial lawyer who loves being in trial if that is what is in the best interest of the client.I represent lawyers and other professionals in malpractice claims, defend insurers in coverage and “bad faith” litigation, and represent clients in commercial litigation. I also represent lawyers in disciplinary proceedings, provide legal ethics advice to law firms, act as an expert witness on legal ethics and insurance coverage, and serve as Deputy General Counsel at Wiley.I have acted as lead counsel for trials in the District of Columbia, Florida, Maryland, New York, Texas, and Virginia, as well as for arbitration hearings. On the appellate side, I have argued in the United States Supreme Court, 10 of the federal courts of appeals; the Supreme Courts of Connecticut, Delaware, Maryland (Court of Appeals), North Carolina, and Ohio; and state intermediate appellate courts in several states, including California, Florida, New York, and Texas. Beginning with the Marc Rich cases while I was an AUSA (for those who can remember that far back), I have handled many high-profile representations, including dealing with the press as appropriate. Those matters include conducting an internal investigation for a U.S. Senator and representing the Senator in connection with a grand jury investigation, representing high-level White House officials in connection with criminal and congressional investigations arising from the Whitewater and Monica Lewinsky investigations, and representing Prof. Alan Dershowitz in connection with a defamation case in Florida. I am an Adjunct Professor at the University of North Carolina School of Law, where I am the co-director of the Supreme Court Program.
