Shell Chemicals Canada v. Nova Chemicals Corporation. The Arbitration Act, RSA C A-43. Retained by Shell to serve as the testifying expert to: 1. determine if the ethylene and monoethylene glycol price references in the contract reflected the significant changes in the market and 2. assess the damages associated with using the price references.JSC Cryogenmash v. Steel Authority of India Ltd.(SAIL), International Court of Arbitration, ICC Case No. 18801/CYK/TO, regarding the reasons cited by SAIL for the termination of the Engineering Procurement and Construction (EPC) agreement. I testified on whether the technical changes proposed were in accordance with good engineering practice. Enterprise Products Operating LLC v. AMEC Foster Wheeler USA, Case No. 20•••••55, in the District Court of Harris County, Texas. This matter relates to Enterprise’s claim that the PDH project is $800 million over budget. Served as damages expert regarding EPC contract-related and product offtake damages. I also testified on industry customs and practices. Arbitration between an oil and natural gas transporter and a midstream services provider. This matter relates to operating a natural gas liquids storage facility, pipeline, and an NGL processing facility. I was asked to evaluate and independently assess damages claims related to a failure to receive Propane, Butane and Condensate in Alberta and evaluate whether the other party was a reasonable Operator.Saipem Canada, Inc. v. Sunrise Oil Sands Partnership, BP Canada Energy Group ULC, Husky Oil Sands Partnership, HOI Resources Limited and Husky Oil Operations Limited. I discussed Husky’s opinion regarding damages related to the lost value of deferred production and the cost of constructing similar plants.Engaged to perform a valuation of the joint venture offshore rig business to assess the value to a potential acquisition. Valuation captured both intrinsic value and market-based indicators.
