About Paul Buehler
I work with management on all areas of labor and employment law, providing advice and representation to human resources professionals, business owners, and in-house counsels. I interviewed for my first law firm position at the age of 19, worked through every school break, and graduated from college a year early to start my career as an attorney as soon as possible. I bring the same passion and drive to my client work. Over the last decade, I have amassed significant experience working with employers on issues including policy and handbook preparation, staff and supervisor trainings, wage and hour advice, leaves of absence and reasonable accommodations, and conducting workplace investigations. I also defend employers in federal and state courts, and before various government agencies. With a background in corporate work, I bring a practical and business-focused approach to everything I do for clients. Representative Matters Include- Successfully overturned a $3.2 million jury verdict, and conducted a new trial on damages, resulting in the reduction of the verdict to Reduced verdict was upheld on appeal- Regularly advise employers on reasonable accommodation and leave of absence issues stemming from employee disabilities and religious beliefs- Assisted a national employer with a reduction in force impacting approximately 100 employees across multiple states, including preparing separation packages and advising on WARN Act implications- Regularly obtain dismissal of numerous Division of Human Rights and Equal Employment Opportunity Commission filings- Obtained dismissal of a court complaint alleging breach of a physician contract. Dismissal was upheld on appeal- Obtained dismissal of a court complaint alleging retaliation for internal safety complaints, breach of contract, and constitutional issues- Conducted a hearing before the New York State Division of Human Rights involving allegations of discrimination and harassment against a national retailer, and obtained dismissal on behalf of the employer and individually named employees- Represent employers in connection with New York State Department of Labor audits, often resulting in elimination or significant reduction of initially imposed fines- Conducted a hearing before New York State Industrial Board of Appeals contesting findings of a New York State Department of Labor audit- Conduct workplace investigations involving allegations of discrimination, harassment, retaliation, and other policy violations- Filed an Article 78 proceeding against the New York State Department of Labor contesting determination of wages allegedly owed to former employees, resulting in a settlement for approximately 20% of the originally imposed amount.
