ABOUT NIGEL PARNELL

I am a senior trade mark attorney, with over 30 years\' experience, working with a wide range of clients from the UK, USA and Asia. I have represented well known companies in the sports, media, food, electronics and automotive sectors. I focus on providing clients with clear and realistic advice and with pro-active and practical solutions. My expertise, in addition to wide experience of day-to-day trade mark practice assisting clients with trade mark selection and prosecution, include:* Global portfolio management;* Mergers and acquisitions;* Due-diligence and clearance searches; and * Client representation at EUIPO and UK Intellectual Property Office in opposition, invalidity and revocation proceedings. I filed and registered the first 3-dimensional trade mark in the UK (the shape of the Toblerone chocolate bar) in 1994. Successes in appeals on oppositions to the Appointed Person include Starfire Publishing Limited v. Ordo Templi Orientis [2009] RPC 14 and PetMed Express, Inc. v. Petmeds Limited (BL O/471/11). In case R 2197/2011-2 of 11 May 2012 before the Second Board of Appeal of EUIPO acceptance was obtained of the slogan WE RESTORE, YOU RECOVER, one of the few slogans to have been accepted by EUIPO. Professional qualifications and memberships include:* Fellow of The Chartered Institute of Trade Mark Attorneys (FCITMA),* Registered Trade Mark Attorney (RTMA),* European Trade Mark & Design Attorney (ETMA),* Fellow of The Royal Society for the encouragement of Arts, Manufactures and Commerce (FRSA),* European Communities Trade Mark Association (ECTA)* International Trademark Association (INTA) For over 16 years I was an examiner for The Joint Examination Board of The Chartered Institute of Patent Attorneys (CIPA) and The Institute of Trade Mark Attorneys (ITMA) with responsibility for setting and marking advanced level examination papers for qualification as a RTMA in the UK. I am also a former Council member of ITMA.
