My practice involves working with clients to negotiate NPDES Permits, WDRs, and water reclamation requirements with the State Water Resources Control Board and Regional Water Boards for municipal wastewater, industrial process water, and all types of storm water discharges, as well as reclamation projects. I am also heavily involved in the planning and development stages of water quality-related regulations and policies, including or involving TMDLS, Basin Plans, Recycled Water, and Enforcement and Compliance policies, working closely with appointed members and Executive staff of the State Water Resources Control Board, Regional Water Boards, and the Division of Drinking Water.When unsatisfactory permits or enforcement actions (ACLs) are issued, and all other avenues for conflict resolution have been exhausted, I prosecute administrative and judicial appeals before the State Water Board and all state courts (including a successful decision from the California Supreme Court on the issue of consideration of economics in setting permit limitations in federal NPDES permits). In doing so, I invalidate or refine the interpretation of particularly problematic provisions, and reduce or eliminate the severity of penalties and excessive or unnecessary compliance requirements.Given my knowledge of the complex regulatory schemes created by the federal Clean Water Act and California Porter-Cologne Water Quality Control Act, I am frequently retained to defend public and private entities against third-party citizen suits filed by non-governmental organizations. I have successfully litigated or resolved over fifty such cases in the last fifteen years involving wastewater, process water, and storm water discharges.
