Michael J. DelTergo is an experienced attorney specializing in all aspects of ERISA litigation, Internal Revenue Code and ERISA compliance, corporate startups, estate and trust administration, banking regulation, establishment and governance of nonprofits, general tax planning, and tax controversies and appeals. Mr. DelTergo practices in the ERISA group at Cohen Weiss and Simon in New York, where he represents multiemployer pension and welfare plans in plan design and compliance and tax matters. Previously, Mr. DelTergo worked in the ERISA practices at Jenning Sigmond in Philadelphia, and O’Brien, Belland and Bushinsky in Moorestown, NJ where he represented union-side trustees and administrators of multiemployer plans on a broad range of issues involving ERISA and ACA litigation and compliance, nonprofit formation and operation, general tax questions, and subrogation on behalf of multiemployer welfare plans. In the past, he has advised single employer plan administrators for midsized and large companies on qualified and nonqualified plan establishment, compliance, and termination, IRS and Department of Labor correction programs (EPCRS and VFCP), compliance and reporting, and litigation involving qualified plans. Mr. DelTergo also advises individuals, nonprofits and small business owners on tax matters, and has represented taxpayers before the Internal Revenue Service and the U.S. Tax Court.Mr. DelTergo has also represented banks, bank holding companies and licensed lenders before state and federal regulators as an associate to an AmLaw 50 law firm, and established the probate practice for a small New Hampshire law firm. Mr. DelTergo also clerked for two federal trial court judges, interned for the Department of Justice, and worked in the trust banking industry prior to and after entering the practice of law.
