ABOUT MIGUEL EATON
I help clients solve complex employee benefits issues with an understanding that each matter is not simply about the merits of that particular case, but that each matter presents a business challenge such as a potential impact on the balance sheet, or obstacle to a merger or acquisition. I began my career litigating these issues and over the years have expanded my practice to include counseling clients on benefits issues in M&A deals as well as litigating pension and retiree health benefits issues in bankruptcy. A significant portion of my practice involves multiemployer benefit and pension plans, including counseling contributing employers, litigating withdrawal liability and trustee deadlocks, as well as advising on M&A matters involving such plans. I also advise clients\' benefit committees as they evaluate participants\' claims for pension, health and welfare, and disability benefits. My litigation experience includes defending companies in stock drop cases, breach of fiduciary duty class actions, and retiree health cutback cases, as well as companies being investigated by the Department of Labor and the Department of Justice.My practice also includes pro bono work related to veterans. I represent service members who choose to appeal their disability ratings to the Department of Veterans Affairs. I also have experience with disability appeals to the U.S. Court of Appeals for Veterans Claims and to the U.S. Court of Appeals for the Federal Circuit.
