Labor & Employment – His practice includes jury trials, independent contractor litigation and reclassification issues, internal investigations, labor audits, supervisory and employee training, claims under the Title VII of the Civil Rights Act, Age Discrimination in Employment Act, Americans with Disabilities Act, Fair Labor Standards Act, Family and Medical Leave Act, Employee Retirement Income Security Act, New York State Human Rights Law, New York State Workers’ Compensation Law, New York State Labor Law, and employment agreement disputes. Mr. Sciotti has successfully defended employers in claims where the employer was alleged not to have in place a workers’ compensation or short-term disability policy, and discrimination claims brought pursuant to § 120 of the New York State Workers’ Compensation Law. He has also been successful in reducing fines levied against employers whose workers’ compensation or short-term disability policies have lapsed. Intellectual Property – Mr. Sciotti has prosecuted and defended a wide variety of intellectual property matters, including unfair competition, restrictive covenant, trade secret, and copyright litigation claims in both state and federal court. He represents the American Society of Composers, Authors and Publishers (ASCAP) in federal court in the Northern and Western Districts of New York. In this capacity Mr. Sciotti has successfully represented a host of national musicians and song writers including Bruce Springsteen, Billy Joel, Van Halen, Guns N’ Roses, and Bob Seger. He also assists employers in drafting and implementing employment agreements, intellectual property agreements, restrictive covenants, and policies which protect employers’ intellectual property rights.
