Litigation is more time-consuming and expensive than most business professionals ever anticipate and should be avoided if economically feasible. However, sometimes litigation becomes necessary/inevitable: A long-term client, business owner and entrepreneur, Joseph Radcliff, and his Fishers-based construction company, C.P.M. Construction, several years ago were sued by State Farm based upon unfounded accusations of wrongdoing. In addition to defending Mr. Radcliff and his company’s interests, I assembled a trial team to counter-sue State Farm. Together with Will Riley of the Price Waicukauski & Riley firm, we led the representation of Mr. Radcliff and his company in a six week jury trial. The jury fully rejected State Farm’s allegations and returned a verdict for Mr. Radcliff and C.P.M. in the amount of $14.5 million. Following the trial and confirmation of the jury\'s verdict, SF brought the matter before the Court of Appeals. The verdict was unanimously upheld in a 61 page opinion handed down on April 11, 2013. The Indiana S/CT denied SF\'s Petition to Transfer on October 10, 2013. This is one of the largest defamation awards in U.S. history.
