Maria also defends clients against bid protests brought by competitors. • Provides performance and compliance counseling, and helps clients to successfully navigate all issues arising during performance of a government contract, ensuring that clients preserve claim rights while minimizing conflict and maximizing compensation.• Drafts Requests for Equitable Adjustment and Contract Dispute Act Claims, assisting clients in recovering damages incurred as a result of, among other issues: changes (directed and constructive); defective specifications; differing site conditions; delay, inefficiency, resequencing of work, and acceleration; suspensions; terminations; good faith and fair dealing; and CPARs issues. • Represents clients throughout all stages of CDA Claim litigation before the Boards of Contract Appeal, Court of Federal Claims, and the Federal Circuit, including the drafting of pleadings, discovery, mediation, motion practice, ADR, trial/arbitration, and appeal. • Counsels clients with regard to federal subcontracting issues, including the negotiation of subcontracts with appropriate flow-down clauses and risk-shifting provisions, resolution of prime/subcontractor disputes, litigation of subcontractor pass-through claims, drafting of liquidiating agreements, and litigation of Miller Act claims.• Counsels clients on all aspects of small business procurement in connection with the 8(a), HUBZone, VOSB/SDVOSB and WOSB/EDWOSB programs including eligibility analyses, 8(a) certification, affiliation issues, teaming and joint venturing, and the mentor protégé programs.
