About Marc Fagel

Since retiring from practice as a securities litigator, Marc Fagel has provided consulting and expert witness services in matters involving SEC examinations and investigations, as well as in general litigation involving SEC practices and policies. He currently teaches legal writing and legal ethics at Stanford Law School. From 2013 to 2019, Mr. Fagel was a partner in Gibson, Dunn & Crutcher’s San Francisco and Palo Alto offices and a Co-Chair of the firm’s Securities Enforcement practice group. Mr. Fagel’s practice focused on the representation of public companies and their officers and directors, as well as financial institutions, investment funds, and accounting firms in investigations, examinations, and litigation involving the Securities and Exchange Commission, the Department of Justice, FINRA, and the CFTC. Mr. Fagel also conducted internal investigations and represented clients in related civil actions.Prior to joining Gibson Dunn, Mr. Fagel spent over 15 years with the SEC’s San Francisco Regional Office. He served as Regional Director from 2008 to 2013 and led the SEC’s enforcement and examination programs for Northern California and the Pacific Northwest. Mr. Fagel previously served as Associate Regional Director in charge of enforcement, where he oversaw investigations ranging from public company reporting to insider trading to misconduct by regulated entities. He was at the forefront of the SEC’s initiative on stock option backdating and helmed some of the largest securities fraud cases ever filed in the Pacific Northwest.Mr. Fagel began his legal career as an associate in the San Francisco office of Morrison & Foerster. Mr. Fagel received his undergraduate degree from Princeton University and graduated with Honors from the University of Chicago Law School, Order of the Coif.Mr. Fagel is also actively involved in community service. He has served as a Board member for the Giffords Law Center to Prevent Gun Violence; Jewish Family & Children\'s Services of San Francisco; the ACLU of Northern California; the Association of SEC Alumni; and VoteRiders, a non-partisan organization dedicated to helping voters secure voter ID.
