With over three decades of experience, I specialize in qualified and nonqualified retirement plans and health and welfare benefit plans. Since 1990, I have been advising employers on the design and operation of all types of retirement and deferred compensation plans, including, 401(k), incentive, employee stock purchase, defined benefit, 403(b), 457(b) and 457(f) plans. My expertise extends to counseling clients on numerous medical and other welfare benefit plan matters, such as severance, VEBAs, COBRA, and flexible benefit plans. I have a proven track record of representing employers before the Department of Labor in connection with investigations of retirement plan and welfare plan issues and before the IRS in connection with retirement plan qualification determinations and defect correction submissions.I also provide guidance to employers and retirement plan service providers, including investment professionals and financial institutions, on ERISA fiduciary responsibility and prohibited transaction concerns. My extensive experience covers self-directed brokerage accounts, directed trustee status, plan fees (including 12b-1 fees), and the provision of investment advice.Additinally, I routinely advise private equity funds on ERISA\'s plan asset regulation and on establishing VCOC status.Specialties: 401(k), qualified retirement and health/welfare plan matters, from both a Code and ERISA perspective.
