About Lisa Phelan

I am the Co-Chair of the Global Antitrust Practice at Morrison & Foerster LLP. With more than 25 years of experience in the United States Department of Justice (DOJ), I provide clients with unmatched criminal investigations, litigation, and enforcement experience, to guide them through sensitive matters pertaining to international cartel actions and white collar investigations, and to rapidly assess and address their total exposure to potential claims of unlawful collusion. I know how to talk to competition agency officials so that they will listen. I understand their enforcement goals and processes, and can translate for clients, as we navigate to a favorable outcome. Whether the agency is the DOJ, the FTC or foreign competition enforcers, I walk companies through investigations of alleged monopolization, price fixing, no poach agreements, or other anticompetitive conduct.I am routinely consulted by law enforcement agencies and competition partners around the globe on best practices and policies in cartel enforcement and leniency programs. My clients turn to me for my deep knowledge and expertise in moments of crisis. As a trusted advisor, I regularly help companies and executives when they are subpoenaed, or when enforcement agencies execute a search warrant or stage a dawn raid. With a very specialized skillset, which few in the world possess, I represent clients through each complex step of a cartel investigation, leniency application, plea negotiation, or criminal jury trial. Clients from the top of the tech world to leaders in the healthcare industry to international industrial giants have felt confident with me by their side as we navigate enforcement challenges and investigations. I have prepared clients to appear before Congress, the grand jury, and federal and state prosecutors. I am also an expert in the necessary components of effective compliance programs, and can provide clients with guidance in preventing antitrust problems before they arise, or obtaining credit for a top-notch compliance program, if problems occur.For the last 16 years, prior to joining Morrison & Foerster, I was chief of the National Criminal Enforcement and Washington Criminal I Sections of the Antitrust Division at the United States DOJ, after previously serving as a senior criminal litigator. As chief of the National Criminal Enforcement and Washington Criminal I Sections of the Antitrust Division, I supervised and coordinated all investigative and litigation work on international and national criminal cartel cases.
