ABOUT JONATHAN F. LEE

Dr. Lee provides expert analysis and testimony in intellectual property (IP) and antitrust matters, applying economic principles and data-driven insights to evaluate economic harm in litigation and arbitration.Dr. Lee conducts empirical analyses of market outcomes to formulate damages from claims of diverted sales, price erosion, convoyed and derivative sales, and other sources of lost profits in IP infringement cases, as well as from price fixing and anticompetitive practices in antitrust cases and class actions. He also builds bargaining and negotiation economic models to estimate reasonable royalty damages in IP infringement cases and to calculate the effects of downstream market mergers on upstream wholesale contractual arrangements and pricing.Dr. Lee is experienced in damages considerations in high-tech markets, including for semiconductors, computer processors, software-as-a-service (SaaS), and telecommunications infrastructure. Much of his work has focused on isolating the market effects of a component of a larger, complex product for purposes of damages apportionment and to identify the causal impact of the alleged harm.Dr. Lee has a reputation for clear oral and written communication, distilling complex economic ideas into concise insights. In Canada, he has testified before the Federal Court, and he has worked on matters before the Federal Court, Provincial Superior Courts, the Competition Bureau, and the Canadian Radio-television and Telecommunications Commission (CRTC). In the US, Dr. Lee has worked on matters before US District Courts, the Federal Communications Commission (FCC), the Federal Trade Commission (FTC), and the Federal Maritime Commission. Dr. Lee has also worked on various matters heard in European and Australian venues.
