ABOUT KEVIN J. STEWART
In my work as an immigration attorney, I’m passionate about helping my clients achieve their US immigration goals.Whether it’s guiding a long-time green card holder through the citizenship process, or preparing a complex submission for an employment green card case, it’s seeing my clients succeed that drives me.I began my career as a software technical writer, and while that work was not as interactive and people-oriented, I gained valuable communication and organization skills that I use every day in my legal work.Over the last 10 years, I’ve established my own solo immigration law practice. At first I volunteered as a pro bono attorney preparing applicants for their asylum interviews. Later as I built my practice into a business, I took on more family and employment cases. My practice is currently focused on serving the immigrant founder and startup community in the San Francisco and Silicon Valley areas. This includes O-1A, EB-2 NIW, and EB-1A cases to provide flexible medium-term and long-term solutions for immigrant business owners and employees.Practice AreasEmployment and Business Immigration: Strong experience with rules, regulations, and case processing for employment-based nonimmigrant and immigrant visas, including H-1B, O-1, and P-3 visas. Also handle EB-1A, EB-2 NIW, self-petition cases. Currently completing PERM labor certification for an employer with multiple positions.Family Immigration: Proven track record in family-based immigration cases, including U.S. citizens and permanent residents filing for their spouse, parent, or minor child. Concurrent petition and adjustment of status for US citizen spouses. Petition and consular processing for spouses outside the US. K-1 Fiancé visa cases from filing through consular processing, marriage, and adjustment of status.Naturalization: Advise clients and execute strategies to overcome potential problems for naturalization, such as criminal background affecting moral character, continuous presence, and residence issues.Asylum and Removal Defense: Strong background in asylum law, affirmative and defensive asylum procedure, cancellation of removal, waivers, and other forms of relief from deportation.
