As lead New York counsel, Kieran represented hedge fund managers, investment vehicles and offshore funds in serial cases in the New York courts totaling billions of dollars in dispute. The matters involved, among other things, highly complex “CLO-squared” securitizations, the hedging of warehouse balance sheet risk through the use of structured products, and contested CDS loss calculations and exposure. Kieran successfully argued numerous appeals involving issues of first impression, leading to the dismissal of claims and/or the favorable resolution of the matters as to several clients.Provided extensive antitrust and competition counseling to clients in the oil & gas exploration, worldwide trading, mining, media and hospitality industries. Kieran’s efforts have resulted in closed criminal and civil investigations and avoidance of substantial exposure to his clients.Counseled and litigated on many real estate and land use disputes, involving improperly-issued subprime mortgages, covenants and restrictions, fraudulent conveyances and wetlands regulations.
