I am a trial lawyer with 38 years of experience in litigating high-stakes matters, including environmental enforcement, climate change, and environmental bankruptcy matters throughout the United States. Before joining Jones Day, I served as a trial lawyer at the U.S. Department of Justice for seven years, where I tried many cases in a variety of substantive areas, including environmental law, in courts in Alabama, Mississippi, Indiana, Illinois, Virginia, Washington, and the District of Columbia. During my tenure at the Department of Justice, I received several awards for my trial work from both the Attorney General and the EPA.I have successfully represented manufacturing, utility, chemical, oil and gas, and other industry clients in multimillion dollar civil enforcement and public nuisance actions, OSHA, DOJ and State criminal investigations, toxic tort litigation, and contractual indemnification disputes. I have extensive experience in air and groundwater contamination issues, human and ecological risk assessment, the science of climate change. I led the U.S. portion our Firm\'s investigation of an auto manufacturer in connection with a major Clean Air Act civil enforcement action initiated by the DOJ\'s Environmental Enforcement Section and the parallel criminal investigation by DOJ\'s Criminal Division. I am currently advising clients in connection with the latest wave of climate change tort cases filed in the United States. I was successful in getting the first wave of those cases dismissed by courts in the Second, Fifth, and Ninth Circuit Courts of Appeal and ultimately, the U.S. Supreme Court. I also handle takings cases, including a multi-million dollar one currently pending involving EPA\'s retroactive veto of a Section 404 Clean Water Act permit to mine coal. I frequently provide commentary to the major print and television media on a wide range of environmental litigation issues, including climate change litigation, and federal and state government enforcement efforts.
