JOB SUMMARYInvoking the provisions under SARFAESI Act, Including taking possession(symbolic/physical) and sale of the secured assets.Conducting/monitoring recovery cases file by the Bank, including action undersection 138 of NI Act, Civil Summary Suit.Conducting Legal Audit of all eligible loan account as per policy of the bank andhelping in rectifying the discrepancies as observed in the Audit.Support Vigilance department (RO) in resolving Civil cases filed by th bank.Assistance To branches in resolving legal issues pertaining to various business likeAffordable Housing/MSE etc.Drafting/vetting/review if all kind of credit documentation for MSE and Housing.Vetting of Titl Scrutiny Reports (TSR) submitted by panel Advocate to confirm thatthe TSR satisfies the business requirements of the Bank.Managing legal issues pertaining to creation/registration of Mortgages,Hypothecation etc.2. PRIMARY RESPONSIBILITIESBusinessInvoking the provisions under SARFAESI Act - Sending Demand Notices, takingpossession of secured assets (symbolic/physical) and sale of the same as per theAct/Rules frames thereunder.Ensuring Legal Audit of all eligible accounts as per policy and follow up forRectification.Support Vigilance department (RO) in resolving Civil cases files by Bank.CustomerSupport the secured lending department in resolving NPA Account throughmeasure taken/ to be taken under the provisions of SARFAESI Act (includingmanaging Enforcement Agencies).Support the secured lending department and operations department in regardinglegal support document/ customer issue.Co-ordinate Collections and other verticals for possessions and taking action section14 Applications.Internal processTaking approvsl from, reporting to and apprising various In-House Committees inregards to the matters touching upon the subjects.Assist theses Vertivals in framing processes/policies relating to SARFAESI andother recovery methods
