About Kendall Millard

With over 20 years as a practicing lawyer, my antitrust law experience has both breadth…

Experience

  1. Partner, Co-chair Antitrust Practice Group

    Barnes & Thornburg LLP

Nov 2004 — Present · Indianapolis, IN, US

Over the past five years I focused on international compliance investigations and interviews, leading the Manufacturing and R&D subject matter teams assisting the Special Compliance Coordinator appointed by the U.S. Department of Commerce to monitor, assess and report on the U.S. export control compliance of Zhongxing Telecommunications Equipment Corporation (ZTE). I led over 125 inspections across Europe, China, Southeast & Central Asia, Mexico and South America. My main practice is defending companies against allegations of price fixing, bid-rigging, customer allocation, resale price maintenance, exclusive contracts, tying, bundling, boycotts, monopolization and attempted monopolization brought under Sections 1 and 2 of the Sherman Act, California’s Cartwright Act, New York’s Donnelly Act, and other state competition laws.I regularly conduct antitrust compliance trainings for clients and trade associations in the U.S. and abroad. I advise clients on pricing issues, including Minimum Advertised Price (MAP) policies, competitive intelligence practices, and the Robinson-Patman Act (RPA). I have also represented several pharmaceutical and other R&D-focused technology companies on antitrust aspects of IP licensing and settlement agreements resolving patent disputes brought pursuant to the Hatch-Waxman Act. I have significant experience hiring and managing economists and other subject matter experts in writing and disclosing expert reports, taking and defending expert depositions, and preparing them for trial testimony. My experience includes working with economists in conducting market definitions, regressions and other econometric analyses, and articulating the results in an expert report format easily understood and digestible by a judge and jury.
