Health System and Hospital Operations and Governance: As outside counsel, I provide daily operational counsel to clients, including general risk management advice, medical staff issues, and EMTALA related compliance. Physician-Hospital Contracting: A large part of my practice involves drafting and negotiating various agreements with physicians and referral sources to comply with the Stark Law, Federal Anti-Kickback Statute, and analogous state variations, including: • Physician employment agreements and professional services agreements. • Physician recruitment agreements and timeshare office-space lease agreements.• Purchase agreements for physician-practice acquisitions.Regulatory Compliance: As part of my regulatory practice, I review various Federal and state requirements related to state facility and practitioner licensing, certificate of need laws, and Federal and state reimbursement requirements, including Conditions of Participation and provider-based status.Corporate Compliance and Fraud and Abuse: All aspects of my practice include application of general compliance principles and fraud and abuse prevention. Specifically, I assist clients in: • Review and preparation of corporate compliance materials and compliance programs.• Interpretation and application of CIA provisions. • Review and investigation of fraud and abuse allegations, including preparation and submission of documents to the CMS Self-Referral Disclosure Protocol.
