About Keith Kaplan
I am a Partner in the Garden City, Long Island office of Kaufman Borgeest & Ryan LLP, focusing my practice on the defense of nursing homes in personal injury litigation, handling all aspects thereof. I have been included in the 2023 Edition of Best Lawyers in America for Medical Malpractice Law-Defendants. I have authored several articles regarding nursing home defense, including: “Preservation of ‘Favorable’ DOH Investigative Reports in the Defense of Nursing Homes,” (June 2007 Newsletter, NY Chapter of the American College of Healthcare Administrators), “Venue Selection Clauses in Nursing Home Admission Agreements” (Dec. 2007 issue of Nassau Lawyer),\"Same Difference: Punitive Damages Against Nursing Homes Under Common Law and Statute,\" (April 2012 issue of Nassau Lawyer) and “The U.S. Supreme Court’s Marmet Decision and Its Potential Impact Upon Personal Injury Claims Against Nursing Homes” (Summer/Fall 2012 issue of the NYSBA Health Law Journal). Additionally, I served as a panel speaker at CLE seminars entitled “Introduction to Nursing Home Litigation” for the Suffolk Academy of Law (1/14/09), “An Introduction to Nursing Home Litigation and New York Public Health Law 2801-d” for the Nassau Lawyers Conf. of CLE (11/16/10),\"Medical Malpractice in NY: A View from all Sides,\" NYSBA-TICL Section (10/11/15) and \"Evaluating Nursing Home Negligence Cases\" for the Suffolk Academy of Law (12/2/15). I have also presented in-house CLEs on nursing home defense and co-presented an educational workshop entitled \"Preparing for the Inevitable: The Administrator\'s Role in Operating a Litigation Conscious Facility\" at the Annual Convention of the American College of Health Care Administrators, New York Chapter (3/9/15).
