My practice focuses the representation of public entities in all phases of litigation, including writ proceedings, jury and court trials, and appeals, primarily with regard to complex environmental and general civil litigation. I have extensive environmental cost recovery experience, litigating against responsible parties under state and federal law for liability related to contaminated sediment from WWII-era shipyards, boatyards, marinas, landfills, and municipal storm drains (CERLCA, HSAA and Superfund sites). I have worked extensively with the USA EPA, DOJ, Departments of Fish and Wildlife and Agriculture and the California State agencies, including the California Energy Commission, Public Utilities Commission, Air Resources Board, Department of Toxic Substances Control, and State and Regional Water Boards. I work closely with consultants and technical experts in areas including forensics for source determination of hazardous chemicals, best management practices, sediment and contaminant fate and transport. I have been successful in negotiating and settling claims and lawsuits arising from multi-million-dollar liabilities. I also provides transaction and advisory services to public entities, assisting general counsel for several water districts. In these capacities, I negotiate and draft contracts and advises clients on a broad range of issues, including: regulatory compliance, environmental management, compliance and due diligence, contracts, insurance, the Public Records Act, personnel, public works, water supply, rights and quality, storm water issues and compliance with state and federal laws.
