ABOUT JOSIAH M. DANIEL
I am the author of the first definition of \"lawyering\" to have been published (in 2009 in Law Library Journal), and I work on the history of lawyering. As a legal historian, I have several other ongoing projects. Occasionally I write op-eds. In all my work, I posit that history is our best guide.My largest project is to write, from archival sources, the biography of Dallas congressman Hatton W. Sumners (18••••62), a complex figure who served in Congress 19••••47 and chaired the House Judiciary Committee 19••••47, that is, overlapping the presidency of Franklin D. Roosevelt. One chapter, focusing on Sumners’s key role in resolving the 1937 court-packing crisis, was published on June 11, 2021, in the John Marshall Law Review and has been downloaded more than 700 times (https://repository.law.uic.edu/lawreview/vol54/iss2/1/). Forthcoming soon is another chapter that will be an article on Sumners\'s key involvement in the extensive revisions and additions to bankruptcy law through legislation enacted during the financial distress of the 1930s. I am also working on aspects of the history of bankruptcy law in the USA, and I have completed a history of the Texas Bar Association, 18••••40.An ongoing project on my overall topic of historic lawyering is the remarkable lawyering for the stockholders in In re TMT Trailer Ferry, Inc, a 21-year Ch. X bankruptcy reorganization case (19••••78). In the past two years I\'ve published a major article about what I call \"associational lawyering\" in the matter of railroads\' cooptation, through coordinated litigation to the Supreme Court dozens of times, in cases of freight loss and damage under the 1906 Carmack Amendment to the Interstate Commerce Act.During 39 years of law practice, I formerly represented debtors, lenders, asset purchasers, creditors’ committees, landlords, trustees, and unsecured creditors in corporate and commercial restructurings, in cases under Chs. 7, 9, 11, and even 13 of the Bankruptcy Code, and in advisory work regarding all aspects of debt and restructuring. Occasionally I publish or post commentaries in the area as well as on current events.
