ABOUT JOHN JARVIS
I advise senior business leaders on managing and mitigating legal and regulatory risks arising out of Marsh’s business to foster growth while protecting Marsh’s interests. I have particularly extensive experience in defending professional negligence circumstances and claims (including complex and high value claims), from initial identification of exposure to resolution (by a claimant’s abandoning the claim or through confidential settlement following mediation or negotiation). I have managed a substantial docket of notified circumstances and claims from all segments of Marsh’s business (from consumer and SME to Global Specialty). I have experience liaising with professional indemnity insurers and their counsel.Recently I have advised on the insurance implications of sanctions on Russia and Belarus and insurers’ proposed amendments to policy wordings to address these developments. I have also worked closely with colleagues in Claims and internal technical experts to monitor developments in litigation relating to claims for business interruption losses caused by Covid-19 (including the FCA Test Case and subsequent cases). I have drafted internal and external briefing on these issues, as well as conducting associated training for Marsh colleagues. I attend the Marsh U.K. Corporate Governance and Error and Omission Committees to learn from claims and near-misses and improve Marsh’s processes. I have also trained hundreds of colleagues on best practices to avoid Errors and Omissions Claims. I advised Marsh UK and Ireland on its Brexit preparations, including the establishment of reverse branches of Irish and Belgian entities and associated internal documentation dealing with regulatory and outsourcing arrangements. I also advised on the implications of Brexit for Marsh’s clients’ insurance arrangements. I also provide assistance with aspects of commercial acquisitions, advise on commercial disputes, advise on restrictive covenant disputes regarding solicitation and team moves, and provide ad hoc legal advice on other legal and regulatory issues.I manage a junior solicitor and help him develop as an in-house lawyer. Before I joined Marsh, I was an associate and solicitor advocate (with Higher Rights of Audience for civil matters) in the disputes division of Herbert Smith Freehills, specialising in insurance and professional negligence dispute resolution.I am a proud father, an ardent cook and a keen cyclist.
