I\'m certified as a specialist in appellate law by the State Bar of California and have more than two decades of appellate litigation experience. I\'ve argued over 40 cases in the state and federal appellate courts, and have been the principal brief-writer in more than 100 appeals and writs. I was the 2020 President of the San Diego County Bar Association, which serves nearly members of the San Diego legal community.I regularly represent large companies, closely-held corporations, small businesses, and individuals in high-stakes appellate matters. I\'ve handled cases on subjects ranging from business torts to healthcare law to employment, insurance, contract, and intellectual property disputes. I also represent clients in anti-SLAPP, unfair competition, securities, and public entity appeals, as well as administrative law and consumer class action litigation.I\'ve been named to San Diego\'s \"Super Lawyers\" list for Appellate Litigation in each year since 2015, an honor reserved for the top 5% of appellate attorneys and awarded based upon merit selection criteria in addition to review by peer attorneys. From 20••••24, I\'ve been named by Super Lawyers one of San Diego’s “Top 25 Women Attorneys” and among the “Top 50 Attorneys” overall in the region. And, since 2024, I\'ve been named one of \"The Best Lawyers in America\" in Appellate Practice.Since January 2023, I have served by appointment of the U.S. Court of Appeals for the Ninth Circuit as Chair of the Appellate Lawyer Representatives Committee the Ninth Circuit, a small group of attorneys selected by the Circuit’s judges to work on improving the administration of the court. ABOUT JOHANNA SCHIAVONI
As an experienced appellate lawyer, I represent companies, individuals, and public entities in high-stakes appeals and writs. During more than two decades of practice, I have been the principal brief-writer in over 100 cases and have argued more than 40 appeals in federal and state courts. I bring a strategic lens to analyzing legal issues, while working collaboratively with clients and trial lawyers. This requires understanding the legal and factual landscape of the case and creatively distilling complex issues into a focused and compelling narrative. Appeals involve many key components – from vital work in the trial court to set a case up for success, to litigating the appeal, and handling post-appeal matters. But an appeal is not a re-run of trial court proceedings. Clients and trial counsel engage me to- evaluate whether to bring a writ or appeal- handle an appeal from start to finish- represent amicus curiae- work with trial counsel to prepare key motions (e.g, summary judgment filings, motions in limine), special jury instructions and verdict forms- prepare post-appeal petitions for panel rehearing or rehearing en banc- recommend whether to seek review in the California or U.S. Supreme Court and handle these proceedings.My substantive experience includes litigating California business torts, contracts, employment law, privacy, civil procedure, patents, copyrights, trademarks, trade dress, trade secrets, unfair competition, commercial fraud, insurance, securities and health care matters, constitutional law, regulatory and administrative issues, consumer class actions, and claims against public entities. Since 2016, I have been certified as a specialist in appellate law by the State Bar of California—a distinction earned by fewer than 300 attorneys of the lawyers in California. I worked as a judicial law clerk for two different federal judges—U.S. District Judge Christina A. Snyder in Los Angeles and Ninth Circuit Court of Appeals Judge M. Margaret McKeown.In addition to my law practice, I am committed to volunteer service because I believe lawyers play a unique role in tackling complex challenges in our society. Presently, I Chair the Ninth Circuit’s Appellate Lawyer Representatives Committee.I served as the 2020 President of the San Diego County Bar Association, representing nearly members during the COVID-19 pandemic. I volunteer with other organizations committed to developing the next generation of leaders in our community, supporting the arts, and advancing the status of women in the law and society.
