ABOUT JERRON WHEELER

My forthcoming article in the Washington and Lee Law Review examines Medicaid’s Early and Periodic Screening, Diagnostic, and Treatment (EPSDT) benefit as a case study in regulatory failure. Despite Congress’s clear mandate to provide comprehensive care to children, outdated federal regulations have allowed states to narrow EPSDT’s scope, often with judicial approval. The article argues that restoring the benefit’s full promise requires modernizing the federal regulatory framework. In an era of legislative gridlock and judicial retrenchment, it makes the case that informal rulemaking under the Administrative Procedure Act offers the most democratic and immediate pathway to enforce statutory entitlements and protect vulnerable populations.
