Jeff Gilbreth concentrates his practice in the areas of labor and employment law litigation and counseling. He counsels clients on a variety of employment law matters including, hiring and retention, discrimination, sexual harassment, employee corrective action, discipline and discharge, investigations, managing leaves of absence, deductions from employee wages, exempt/non-exempt classification of employees, workplace privacy, drug testing, and FLSA and other wage-hour compliance. Jeff also advises clients on reductions in force (RIFs) and other restructurings, including compliance with OWBPA, WARN Act and COBRA requirements. In addition, Jeff conducts wage and hour audits and management and staff trainings regarding sexual harassment, workplace investigations, and managing leaves of absence. He regularly negotiates and drafts various employment agreements including, offer letters, confidentiality, non-competition, separation, and retention agreements, as well as bonus/commission plans and drug/alcohol testing policies. He also reviews employee handbooks and personnel policies.Jeff\'s litigation experience includes representing employers in state and federal court proceedings and administrative charges before the MCAD, EEOC, and the Massachusetts Attorney General. The nature of the employment litigations Jeff has handled runs the gamut from defending multi-million dollar FLSA class actions to wage act violations, violations of restrictive covenants, and discrimination complaints. Jeff also has experience negotiating with unions, defending unfair labor practice charges and representing employers in of the grievance and arbitration process.Jeff began working at Nixon Peabody in September 2004 as an Associate and was promoted to Partner in February 2013.Jeff was selected a \"Massachusetts Rising Star\" in 2007, 2008, 2009, and 2011 by Massachusetts Super Lawyers.
