ABOUT J. LOGAN RAPPAPORT
I shepherd corporate and individual debtors in financial distress through bankruptcy or, where possible, utilize non-bankruptcy options, including private workouts and litigation, and represent creditors including lenders, merchant cash advance entities, landlords, vendors, equipment finance and leasing companies, and individuals in all phases of bankruptcy. I have extensive litigation experience having represented litigants in the US Court of Appeals for the Second Circuit, EDNY, SDNY, WDNY, the Bankruptcy Courts for the SDNY, EDNY, WDNY and various state courts with respect to a variety of claims, including fraudulent conveyances under both the Bankruptcy Code and New York Debtor & Creditor Law, preferential transfers, breaches of contract and various legal and equitable claims sounding in quasi-contract, business torts, objections to discharge, and objections to the dischargeability of debts. I\'ve represented several chapter 7 trustees in the prosecution of avoidance actions and general case administration and asset liquidation, including sales of real and personal property. Notable Chapter 11 debtor-in-possession representation includes that of an ophthalmic lens manufacturer resulting in the sale of substantially all assets, and several Pearle Vision franchises resulting in a confirmed plan of reorganization. Selected case work includes:(i) the prosecution and settlement of a breach of contract action against a major national fitness company;(ii) representation of a media firm in litigation and negotiations helping clear over $2 million in unsecured representation of an advertising company in federal and state court actions with respect to contractual breaches for work performed in connection with NBA All-Star Weekend;(iv) prosecution and settlement of fraudulent conveyance actions flowing from a multi-million dollar Ponzi scheme that had been perpetrated by a prominent New York attorney;(v) prosecution and settlement of a $15 million fraudulent conveyance action stemming from a highly leveraged purchase of a importer of licensed toys;(vi) representation of a global shipping company in several high profile chapter 11 cases, including Sears and Firestar Diamond;(vii) represented the former CTO of Gawker Media in negotiations with its bankruptcy trustee regarding payment of representation of Condé Nast in several major Chapter 11 bankruptcy won summary judgment in a published decision for a pro bono client in a fraudulent conveyance action saving the client\'s home.
