About Herman Yue
I am an Intellectual Property Litigation partner in the New York office of Latham & Watkins. My practice focuses primarily on patent litigation in the life sciences and biopharmaceutical space, including litigation under the Biologics Price Competition and Innovation Act (BPCIA), the Hatch-Waxman Act, and traditional brand-on-brand competitor litigation. In addition to my biologics and pharmaceutical cases, I\'ve litigated patent cases involving medical devices, gene editing technology, and computer technology. I\'ve also handled matters before the USPTO (such as inter partes review proceedings) as well as cross-border proceedings involving patent offices and courts in various jurisdictions around the world, including Europe, Japan, China, and South Korea.In addition to my litigation-related practice, I routinely provide strategic patent counseling to clients in addition to analysis in anticipation of litigation and IP due diligence in the context of larger transactions. I also maintain an active pro bono practice, including immigration asylum cases and predatory housing matters.Earlier in my legal career, I had the privilege of serving as a law clerk to the late Judge Robert W. Sweet, Southern District of New York. Before practicing law, I earned my Ph.D. from UC Berkeley\'s Molecular Cell Biology program, where I studied the role of mammalian TRAIL receptor in the development of immune responses.Portions of this profile may constitute attorney advertising.
