ABOUT MICHAEL GAUGHAN

In 2023, I was invited to join Muse Places Limited (part of the Morgan Sindall Group) by the inimitable Sarah Anne Shankland who was sadly retiring. My primary focus is leading Morgan Sindall\'s legal response to the the Building Safety Act 2022. I am responsible for compliance with the new regulatory environment, the Developer Remediation Contract, safety remediation projects for legacy buildings, management of financial provisioning and recovery actions against third parties. Aside from the BSA project, I deal with a diverse range of disputes relating to development agreements, construction contract, and landlord and tenant / asset management issues. I have gained experience in construction and engineering disputes including Defective Premises Act claims, appointments and warranties, payments / retentions, third party rights, insurance & professional indemnity, loss & expense, EoT, liquidated damages, Contribution Act, and some adjudication.On the non contentious side I have been involved in the negotiation of appointments and warranties, PCSAs, building contracts and Works Contracts / Funding Agreements often in relation to the Developer Remediation Contract with MHCLG. I am a strong negotiator and have extensive alternative dispute resolution experience particularly at mediations. I have private practice experience, mainly with DLA Piper and latterly at Shoosmiths. My private practice specialism was property litigation but I enjoyed a very broad practice, often with a professional negligence / banking / insolvency angle.
