Derek Bell\'s practice focuses on Commercial List litigation, including merger and acquisition litigation and insolvency matters, and competition litigation. He represents a wide variety of industries and business sectors, including public issuers, individual directors and officers, banks, securities dealers, manufacturers, and private and public investment funds.Derek represents clients at all levels of court and administrative tribunals in Ontario, British Columbia, the Federal Court of Canada, and the Supreme Court of Canada. Derek regularly writes for industry publications and associations on litigation matters.In his practice, Derek is known for finding creative and innovative approaches to achieve results for his clients. He was lead counsel on the first reported case in the history of Canada where a publc issuer merger was successfully blocked at a fairness hearing. By contrast he has been counsel on a number of cases where challenges to mergers have been successfully resisted. In 2012, he was lead counsel in two decisions, released the same day by the same judge, which successfully ousted a case on jurisdiction grounds in the one, while successfully resisting a jurisdictional challenge in the other. And finally, he was lead counsel for the Commissioner of Competition in a successful decision resulting in the largest administrative penalties for misleading advertising being awarded in the history of Canada.In Derek clerked with the Honourable Justice Charles D. Gonthier at the Supreme Court of Canada.
