As an Attorney, debt buyer and portfolio manager I am currently providing recovery litigation, legal outsourcing and portfolio management services for my own account and to clients in both the commercial and consumer markets. The procedures I have implemented are invaluable to a successful accounts receivable recovery matrix.The most important aspect of managing legal processes in the ARM industry is fostering TRUST between you as the manager of the process, the corporate decision makers, the clients, and the law firms. The biggest barrier to increased liquidation rates and performance is a communication breakdown between these key players in a very fluid and changing market. The ARM company needs to have confidence in the manager. The clients need not only results but need to understand the legal collection process and various stages involved leading to the resolution of accounts. The law firms need to have confidence that they will be provided with all the tools they need to successfully prosecute the accounts. This includes providing updates on changes in the law, training for the staff including motivation and education presentations and most importantly the confidence that they will be promptly provided with the documents and witnesses they need to obtain judgment for the client. This avoids the many pitfalls we, as ARM professionals, face in this environment where even the appearance of non-compliance will buy you a lawsuit from an overzealous debtor\'s attorney.From the CEO of the ARM company to the paralegal preparing the complaints, the knowledge that their requests and questions will be promptly addressed is invaluable in fostering this essential element of TRUST.
