Defective Pricing & Cost Disputes. David has handled a busy docket of defective pricing appeals and claims, DCAA audit allegations, and other disputes involving cost/pricing issues. Recognized in Chambers USA as “the top expert on defective pricing,” he led more than a dozen defective pricing litigations in the past 8 years, wrote the Defective Pricing Handbook (20••••25 editions), and taught thousands of private & public sector professionals. Over his career, he has litigated over $1.5 billion in defective pricing claims with a 97% success rate (Government recovering less than 3 cents on the dollar).Protest Litigation. Since his first protest in 1982, David has litigated and defended more than 70 protests in every forum (GAO, COFC, ODRA, & GSBCA), with some of the best being successfully resolved without a decision – e.g, agency corrective action and award in a $6 billion procurement for Fortune 25 company. Many of his protest wins have centered upon cost and pricing issues.False Claims Act & Contract Disputes. From his first hearing in 1982, David has spent more than 100 days in the courtroom litigating False Claims Act (FCA) suits, default terminations, prime/sub disputes, and other actions involving complex military and aerospace systems, IT systems, damages calculations and methodologies, and other government contracts disputes.Honors & Recognition.
