About David Warner
I am a seasoned legal counselor and advocate with more than twenty-five years of experience in the resolution and litigation of complex business and employment disputes with a particular focus in the government contractor and association/nonprofit industries. My clients range from multi-national corporations, to small disadvantaged businesses, to individual executives. Regardless of the client or scope of engagement, my approach is consistent - identify and understand the client\'s strategic goal and attain that goal as quickly and cost-effectively as possible. My core practice areas include commercial dispute resolution and litigation; employment counseling and litigation on behalf of both employers and executives; and government contracts compliance counseling, bid protests, claims, appeals, audits, and investigations. In my counseling practice, I work proactively with my clients to identify and mitigate potential legal risk. Often clients contact me when an issue - either a right to assert or a claim to defend - has already arisen. In those circumstances, when reason is not able to prevail, I am an effective trial advocate, calling upon more than two decades of first-chair experience in adversarial proceedings before federal and state courts and administrative agencies and third party neutrals.

I have litigated hundreds of matters concerning alleged violations of Title VII, the ADA, ADEA, and other federal and state laws prohibiting discrimination and retaliation as well as commercial business dispute, including breach of contract, unfair trade practices, employee, piracy, business conspiracy and other business torts. I routinely represent federal contractors in agency and GAO bid protests and with respect to claims and appeals before the Civilian Board of Contract Appeals, the Armed Services Board of Contract Appeals, and the Court of Federal Claims.In addition to day-to-day counseling on contractor compliance and employment actions, I routinely provide guidance concerning the design and implementation of effective and defensible application, hiring, promotion, and compensation practices, including conducting comprehensive audits of personnel practices to proactively identify and remediate issues that could give rise to class claims. I have extensive experience in the negotiation of executive employment agreements and in the implementation and enforcement of non-compete and related restrictive covenant agreements. I have also conducted numerous internal investigations and defended the rights of individual executives subject to such investigations.I routinely represent federal contractors in affirmative action, Davis-Bacon Act and Service Contract Labor Standards compliance audits and have represented a wide range of businesses with regard to wage and hour compliance, DOL audits, investigation, and litigation.
