ABOUT DAVID ELKANICH

My practice focuses on litigation, with an emphasis on legal ethics and risk management. I advise both lawyers and law firms in a wide range of professional responsibility matters. I also have experience defending lawyers in attorney discipline matters, and in related litigation, such as sanction, withdrawal and disqualification motions, and fee disputes.I enjoy counseling lawyers and other professionals on how to navigate an digital practice, including the rules of engaging in online activity, mining metadata, and in utilizing social media and AI. I am increasingly interested in how lawyers and law firms need to take care of confidential information in a digital practice and as such, I speak frequently on issues relating to cloud computing, data privacy and security issues particular to lawyers.I also enjoy thinking about innovation in the practice of law - including how lawyers can more effectively deliver legal services to clients and how the law firm model may be slowly changing (or quickly - depending on your perspective).When not representing lawyers, I have a commercial litigation practice, where I represent clients in state and federal court in Oregon, Washington and Idaho. I have experience with financial services litigation, professional liability defense, environmental litigation, commercial disputes and product cases. In the financial sector, I represent national banks, mortgage bankers, loan servicers, debt collectors and consumer finance companies, in class actions and individual matters involving various federal and state regulations.
