Dave McClurg\'s extensive litigation experience and focus on employment issues over the past fifteen years make him one of the senior members of Petrie + Pettit\'s Labor & Employment practice group. Dave has a long track record of successfully defending employers accused of wrongful termination and discrimination on the basis of race, religion, age, disability and gender. He has also helped many clients defeat the harassment, retaliation and failure to accommodate claims often associated with these discrimination suits. Dave frequently represents employers facing OSHA violations and workers compensation claims alleging “unreasonable refusal to rehire” following a work related injury. Dave has a wealth of experience involving the litigation of wage & hour, theft of trade secret and breach of duty of loyalty claims, and the drafting and enforcement of non-compete and confidentiality agreements. He also counsels management on union avoidance strategies and represents businesses in grievance arbitration hearings.Although Dave is an experienced litigator, much of his time is devoted to minimizing the risk of litigation by helping his clients develop appropriate employment policies, manuals, procedures and agreements to address potential problems before they arise. He regularly advises clients on issues relating to reduction-in-force layoffs, terminations and severance agreements. Dave is a member of the Labor & Employment Sections of the Milwaukee, Wisconsin and American Bar Associations.
