ABOUT DANIEL TUNKEL

I have been involved with the development of UK financial services law and regulation since I qualified as a solicitor in 1987. Financial markets regulation has developed in many respects over this period, and continues to develop and change as more areas come within regulation and the rules for existing disciplines are modified to reflect changes in the markets and their participants. The area is never less than thoroughly absorbing.Specialties: I work across the financial markets sector, advising fund managers, broker-dealers, private asset managers and banks, and also in less-well-recognised areas such as payment services, electronic money issue, consumer credit and insurance mediation. More recently, I have become deeply involved in newer areas of activity, such as payment systems, peer-to-peer lending and mortgage regulation. And crypto-currencies and crypto-securities are becoming ever more significant as well.The pace of change in this industry is increasing - as if that were possible - and the impact of technology on the UK market, along with the need to reinvent a lot of what we do in the wake of Brexit, will make for a challenging few years ahead.And then there’s Brexit. I voted to remain and I still think the Country made the wrong choice. But a sensible lawyer looks forward and doesn’t try to religitigate the past. My point is that since we took the momentous decision to separate from Europe and the EU Single Market, and we knew we were doing this from 2016 onwards, it beggars belief that we have not done more to capitalise on this change. I’m often asked how FS regulation is affected by Brexit and have so far to say somewhere between not very much and not at all. Maybe, and we can hope a little here, we will get a system suited to the UK and can jettison the EU version of FS regulation that many claimed was decisive in their voting to leave. Let’s just say that I’m here waiting for that to happen and to advise folk on a simplified and materially improved domestic regime.
