Nearly every decision you make with another person requires negotiating, from deciding where to eat lunch together, to how much you’ll pay to buy a car or a house. Negotiation is at play even in common-place interactions with strangers, like in allowing a vehicle in the next lane to merge, or buying something off craigslist. Lawyers will invariably negotiate much more than they will ever litigate. Most criminal matters are resolved through guilty pleas, and most civil cases are settled before trial. You will negotiate with opposing counsel many times more than you will ever face him/her/them in a courtroom.Through role-playing simulations, class discussions, reading assignments, and regular writing exercises, this course examines the basic stages of a negotiation and the major tensions at play in negotiation.
