    As an ERISA Disability Attorney I fight to maintain my client\'s livelihood and lifestyle by securing their disability benefits wrongfully denied by their insurance carrier. As part of my case evaluation I will: Obtain and review the claims file from my client’s disability insurance company. Obtain and review the insurance policy, ERISA plan, and SPD from my client’s disability insurance company and/or employer. Obtain and review any updated medical records that have not been provided to the disability insurance company. Compare the definitions of long-term disability and any policy limitations to past court interpretations (there are about eight to 10 standard definitions of “disabled” that various insurance companies may have). Outline the insurance company’s claim notes, which often reveal the basis of the denial. Prepare a report outlining the strengths and weaknesses of my client’s case, and propose a course of action, including a step-by-step plan and a proposed litigation plan where litigation is appropriate. Obtain my client agreement to this course of action, and recommend any necessary medical evaluations, meet with their treating physicians, obtain necessary medical reports, arrange a functional capacity evaluation and/or vocational evaluation, secure statements from friends or family, and perhaps prepare a video of their job, daily activities, or other relevant evidence as appropriate. Timely file any necessary administrative ERISA appeal and monitor the long-term disability insurance carrier’s response. Prepare a post-acceptance report regarding future disability issues that may arise in their case with a proposed course of action. If appeal is denied, prepare and file Complaint in Court, engage in all applicable discoveries, prepare for and attend all mediations with client, prepare Motions For Summary Judgment and, when appropriate, prepare for a jury trial (individual disability claim).
