About Brian Nese
As a member of Stoel Rives\' Energy Development group, I help renewable energy project developers develop, build, finance, own and operate projects. Stoel accomplishes this by providing project developers a one stop, full service solution to successful renewable project development-from securing site rights to obtaining permits, locking up supply, construction, interconnection, offtake, tax and financing. Personally, I focus on construction, supply, O&M, services, joint development, structuring, real estate and permitting. My background in civil litigation helps me anticipate problems and disputes before they occur and manage them effectively when they emerge.Here is a list of representative matters:9 MW Distributed Rooftop PV Project - We assisted a supplier/installer in structuring, negotiating and contracting for a 9 MW rooftop PV project in New Jersey. When completed, the system will be the largest in the United States. Key agreements included EPC, O&M, Output Guarantee, and Solar Renewable Energy Credit Purchase and Sale Agreement.250 MW Utility Scale Solar Project - We represented a project developer/contractor with sale and ongoing development of a 250 MW PV project and assistance with securing a DOE Loan guaranty. Key documents include EPC and related subcontracts.90 MW PV Project - We assisted a project developer with obtaining a conditional use permit from Los Angeles County for a 90 MW PV project. The key to this project was successfully obtaining project approval while relying on a mitigated negative declaration and placating local opposition groups.Warranty Disputes Re Failed Wind Turbine Gearboxes - We have assisted multiple wind project owners in disputes with turbine suppliers regarding failed gearboxes.
